Terms and conditions
These terms govern access to and use of Areeva’s website, platform and services. Please read them together with the Privacy Policy.
1. Agreement
These Terms and Conditions govern access to and use of the Areeva website, platform and related services operated by AREEVA Limited (together, the “Service”). Our Privacy Policy also applies to use of the Service.
By accessing or using the Service, you confirm that you have read and understood these terms and the Privacy Policy and agree to be bound by them. If you do not agree, you must not use the Service. Questions may be sent to GDPR@areeva.ai.
2. Communications
When you ask to hear from us or use relevant parts of the Service, we may send service, product, newsletter, marketing or promotional communications. You may opt out of marketing messages using the unsubscribe option in a message or by emailing GDPR@areeva.ai. Service and account communications may still be required.
3. Promotions
A contest, sweepstake or other promotion may have separate rules. Those rules and our Privacy Policy apply to participation. If promotion rules conflict with these terms for that promotion, the promotion rules take precedence.
4. Your content
You are responsible for information, text, graphics, audio, video and other material you submit, store, share or otherwise make available through the Service (“Content”), including its legality, reliability and appropriateness.
You retain your rights in your Content. By submitting Content, you grant AREEVA Limited the non-exclusive rights needed to host, use, reproduce, modify, display and distribute it through the Service and to make it available to authorised Service users. You confirm that you own the Content or have the rights required to grant this licence and that its use does not violate another person’s rights.
AREEVA Limited may monitor, moderate, edit or remove Content but is not obliged to do so. Content supplied by Areeva remains the property of AREEVA Limited or its licensors and may not be commercially reused without prior written permission.
5. Prohibited uses
You may use the Service only for lawful purposes and in accordance with these terms. You must not:
- violate any applicable law or regulation, infringe another person’s rights, or use the Service for unlawful, fraudulent, threatening or harmful activity;
- exploit or harm minors, impersonate any person or organisation, or misrepresent your identity or affiliation;
- send spam, junk mail, chain letters, unauthorised advertising or similar solicitations;
- disable, overload, damage, disrupt or interfere with the Service or another person’s use of it;
- use robots, spiders, scraping tools or manual processes to monitor or copy the Service without written permission;
- introduce malware or harmful code, attempt unauthorised access, attack the Service or connected systems, or bypass security controls;
- falsify company ratings or otherwise interfere with the proper operation of the Service.
6. Analytics
We may use service providers to monitor and analyse use of the Service. Their handling of personal data is governed by our Privacy Policy and applicable contractual and legal requirements.
7. No use by minors
The Service is intended for people aged 18 or over. By using it, you confirm that you are at least 18 and have the authority and capacity to enter into these terms.
8. Accounts
Account information must be accurate, complete and current. You are responsible for keeping credentials confidential, restricting access to your account and all activity under it. Notify us immediately of unauthorised use or a security breach.
You must not use a username that is unlawful, misleading, offensive, unavailable to you or protected by another person’s rights without permission. We may refuse service, suspend or terminate accounts, or remove Content where reasonably necessary to operate and protect the Service.
9. Intellectual property
The Service, its original content, features, design and functionality—excluding Content supplied by users—are and remain the exclusive property of AREEVA Limited and its licensors. They are protected by copyright, trade-mark and other laws. Areeva names and marks may not be used without prior written consent.
10. Copyright policy
We respect intellectual-property rights. If you believe material on the Service infringes your copyright or other intellectual-property rights, email GDPR@areeva.ai with the subject “Copyright Infringement” and enough detail for us to identify the work, the material and the basis of your claim. Misrepresentation or bad-faith claims may create liability.
11. Copyright notices
A copyright notice should include the signature of the authorised rights holder or representative; a description of the protected work; the exact location of the allegedly infringing material; your address, telephone number and email; a good-faith statement that the use is unauthorised; and a statement that the information is accurate and that you are authorised to act. Send notices to GDPR@areeva.ai.
12. Error reporting and feedback
You may send errors, suggestions, ideas, complaints and other feedback to GDPR@areeva.ai. Feedback must not contain another person’s confidential or proprietary information. To the extent permitted by law, you grant AREEVA Limited and its affiliates a transferable, irrevocable, worldwide, perpetual, royalty-free and sublicensable right to use, adapt, publish and commercialise that feedback without an obligation of confidentiality or payment.
13. Third-party services
The Service may link to or embed websites and services that AREEVA Limited does not own or control. We are not responsible for their content, terms, availability, privacy practices or any loss arising from reliance on them. Review the terms and privacy policies of third-party services before using them.
14. Disclaimer of warranty
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, AREEVA Limited and people associated with it make no express or implied warranty about operation, completeness, security, reliability, quality, accuracy, availability, merchantability, non-infringement or fitness for a particular purpose.
We do not warrant that the Service will be uninterrupted, error-free, free of harmful components, that defects will be corrected, or that it will meet every requirement. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.
15. Limitation of liability
To the fullest extent permitted by law, AREEVA Limited, its officers, directors, employees and agents are not liable for indirect, punitive, special, incidental or consequential loss arising from or connected with the Service, these terms or a breach of law by a user.
Where liability cannot be excluded, Areeva’s aggregate liability is limited to the amount paid for the product or service giving rise to the claim. These limits do not apply where prohibited by law and do not affect rights that cannot legally be limited.
16. Termination
We may suspend or terminate an account or access to the Service, including for breach of these terms. You may stop using the Service at any time. Provisions that should survive termination—including ownership, warranty, indemnity and liability provisions—continue to apply.
17. Governing law
These terms are governed by the laws of the United Kingdom, without regard to conflict-of-law rules. A failure to enforce a right is not a waiver. These terms and the Privacy Policy form the agreement governing the Service and replace prior agreements about the same subject.
18. Changes to the Service
We may withdraw, change or restrict all or part of the Service. Availability may be interrupted for maintenance, security, operational or other reasons. To the extent permitted by law, we are not liable solely because all or part of the Service is unavailable.
19. Changes to these terms
We may amend these terms by updating this page. You should review them periodically. Continued use after revised terms take effect means you accept them; if you do not accept a revision, you must stop using the Service.
20. Waiver and severability
A waiver of one term is not a continuing waiver or a waiver of another term. If a court or competent tribunal finds a provision invalid, illegal or unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will continue in effect.
21. Acknowledgement
By using the Service, you acknowledge that you have read these Terms and Conditions and agree to be bound by them.
